  • Membership Cancellations: Members may cancel their memberships with a 30-day notice prior to the next billing cycle to avoid further charges. Refunds for memberships are not available, but members can utilize their benefits until the end of the current billing period.
  • Refunds for Products: Any products purchased (e.g., equipment, apparel) can be returned within 30 days of purchase for a full refund, provided they are in their original, unused condition. Proof of purchase is required for all returns.

These risks include, but are not limited to, personal injury, damage to property, and loss of belongings.

Clients are responsible for ensuring that they are physically and medically fit to participate in golf-related activities. Golf Guru recommends that clients consult with a healthcare professional before undertaking any new physical activity. Clients must follow all safety instructions and guidelines provided by Golf Guru staff and are responsible for their own actions and well-being.

Limitation of Liability

To the fullest extent permitted by law, Golf Guru, including its owners, employees, agents, and affiliates, shall not be liable for any injuries, damages, claims, liabilities, costs, expenses, or losses resulting from the participation in any activity or service provided by Golf Guru. This limitation of liability applies to direct, indirect, incidental, consequential, special, punitive, or any other types of damages, even if Golf Guru has been advised of the possibility of such damage.

Waiver of Claims

By agreeing to these Terms of Service, clients waive any and all claims, now known or hereafter known in any jurisdiction, against Golf Guru, its officers, directors, employees, agents, affiliates, successors, and assigns, arising out of or attributable to the client's participation in any activities conducted by Golf Guru, whether arising out of the negligence of Golf Guru or any third parties.

Equipment and Facility Use

Clients agree to indemnify, defend, and hold harmless Golf Guru from any and all claims, liabilities, damages, and expenses (including attorneys’ fees) arising from their violation of these Terms of Service, misuse of Golf Guru’s services or facilities, or their negligence or misconduct.

This content is provided to clients for personal, non-commercial use only within the context of the services offered by Golf Guru.

Copyright and Use Restrictions

Clients may not copy, reproduce, redistribute, transmit, broadcast, display, sell, license, or otherwise exploit any content or materials provided by Golf Guru without prior written consent from Golf Guru. The use of Golf Guru’s materials and content is limited to personal and non-commercial purposes, specifically as part of the instruction and services received from Golf Guru.

User-Generated Content

Golf Guru may allow clients to create, post, or share their own content, such as reviews, comments, or personal achievements, on Golf Guru platforms or social media channels. By generating content, clients grant Golf Guru a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

Protection of Intellectual Property

Golf Guru respects the intellectual property rights of others and expects the same from its clients. Any infringement or violation of intellectual property rights, including the unauthorized use of Golf Guru’s materials or the infringement of third-party rights, may result in immediate termination of services and/or legal action.

Notification of Infringement

If you believe that your intellectual property rights have been violated in connection with our services, or if you have been accused of infringing upon another’s rights, please contact Golf Guru immediately. Golf Guru will respond to all such notices and comply with applicable laws regarding copyright and intellectual property.

Termination of Service

Golf Guru reserves the right to terminate or suspend access to our services and facilities for any client without prior notice or liability, for any reason whatsoever, including but not limited to a breach of the Terms of Service. Similarly, clients have the right to terminate their use of Golf Guru services at any time.

Conditions for Termination by Golf Guru

Termination of services may occur under circumstances including, but not limited to:

  • Violation of the User Conduct and Prohibited Activities guidelines.
  • Failure to pay for services or memberships in accordance with our Payment and Refund Policy.
  • Misuse or damage of Golf Guru property or facilities.
  • Any behavior or action that, in the judgment of Golf Guru, is harmful to the operation of the studio, its clients, or its staff.

Client Initiated Termination

Clients wishing to terminate their memberships or discontinue using Golf Guru services should contact Golf Guru directly to formalize their decision at least 7 days before there next billing date. Specific conditions or notice periods for termination by clients may be outlined in membership agreements or service contracts.

Effects of Termination

Upon termination:

  • Clients will lose access to Golf Guru services, facilities, and any member-exclusive benefits immediately.
  • Any outstanding fees or charges owed to Golf Guru must be settled.
  • Golf Guru is not obligated to refund any fees paid in advance for memberships or services, except as outlined in the Payment and Refund Policy.

Post-Termination Obligations

Clients are required to return any Golf Guru property, including equipment or materials borrowed for personal use, in their possession at the time of termination.

Governing Law and Dispute Resolution

The Terms of Service and any separate agreements whereby we provide services to you shall be governed by and construed in accordance with the laws of the state of Arizona, United States, without regard to its conflict of law provisions. This choice of law is in place to provide a consistent legal framework that also aligns with where Golf Guru is located and operates.

Dispute Resolution

  • Informal Negotiation: We firmly believe in resolving disputes amicably and efficiently. Before pursuing formal legal action, you agree to first contact us directly to seek a resolution through informal negotiation.
  • Mediation: If the dispute cannot be resolved through informal negotiation, both parties agree to attempt to resolve the dispute through mediation before resorting to arbitration or litigation. Mediation will be conducted under the rules of the American Arbitration Association or another mutually agreed-upon mediator.
  • Arbitration: For any dispute not resolved by informal negotiation or mediation, the parties agree to final and binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, excluding any rules or procedures governing or permitting class actions.
  • Class Action Waiver: The parties further agree that any arbitration shall be conducted in their individual capacities only and not as a class action or other representative action, and the parties expressly waive their right to file a class action or seek relief on a class basis.
  • Exclusive Venue for Litigation: To the extent that the arbitration provisions set forth above do not apply or if a determination is made that the arbitration provisions are unenforceable or invalid, any litigation against Golf Guru (except for small claims court actions) may only be commenced in the federal or state courts located in Maricopa County, Arizona. You hereby irrevocably consent to the jurisdiction of those courts for such purposes.

Changes to Dispute Resolution Policy

Golf Guru reserves the right to change this dispute resolution policy by posting updates to our Terms of Service. Your continued use of our services after such changes take effect constitutes your agreement to the new terms.

By agreeing to these Terms of Service, you acknowledge that you are waiving rights with respect to claims that are at this time unknown or unsuspected, and in accordance with such waiver, you acknowledge that you have read and understood, and hereby expressly waive, the benefits of any state law, and any federal law, that would otherwise limit the coverage of this release to include only those claims which you may know or suspect to exist in your favor at the time of agreeing to this release.
